Terms
1. Who we are and what these terms cover
Envelt (the "Service") is operated by WebsiteDev. Solutions GmbH, a limited liability company (GmbH) registered in Switzerland under company number CHE-982.726.625, with registered office at Kreuzackerweg 14, 3250 Lyss, Switzerland ("we", "us"). These Terms of Service govern your use of the web application at envelt.com, the mail services, the API and any related services. By creating an account you accept these terms, the Acceptable Use Policy, the Billing Terms and the Privacy Policy.
2. Eligibility
You must be at least 16 years old, or the age of digital consent where you live if that is higher, and legally able to enter into a contract. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.
3. Your account
- An account consists of a username and a password. We do not ask for your name, phone number, or another email address.
- Your password derives the keys that protect your mailbox. We cannot reset or recover it. If you lose it, the contents of your mailbox are permanently unreadable, and we are not liable for that loss.
- You are responsible for keeping your password secret and for everything that happens under your account.
- Usernames are first come, first served. We may reclaim usernames that impersonate others, infringe rights, or belong to accounts deleted for abuse.
4. The Service
We provide mailboxes, forwarding addresses, custom-domain support, a web client, optional IMAP/SMTP access and spam filtering, as described on the Service. Free accounts include one mailbox with the storage shown at signup. Paid plans add storage, addresses and features as listed on the pricing page. We may change features, limits and prices; changes to paid plans take effect at your next renewal.
The Service transports email using standard internet protocols. Delivery to third parties depends on their systems; we do not guarantee that any message will be delivered, delivered on time, or accepted by a recipient.
5. Encryption and its limits
Mailbox contents are encrypted with a key pair generated in your browser. We hold only your public key and a copy of your private key wrapped with a key derived from your password. We cannot decrypt stored mail. You understand that: (a) mail you send is handled in plaintext for the moment needed to transmit it; (b) mail arriving is plaintext in memory until encrypted; (c) if you enable mail-app (IMAP/SMTP) access, the server derives your key from your password for the duration of each such connection; (d) email to and from other providers is not end-to-end encrypted unless you and your correspondent use additional tools.
6. Acceptable use
You must comply with the Acceptable Use Policy. In short: no spam, no fraud, no malware, no harassment, no illegal content, no attacks on the Service or others. We may suspend or terminate accounts that violate it, with or without notice depending on severity.
7. Payment
Paid plans are prepaid for the chosen number of months in USDT as described in the Billing Terms. When a plan expires, the account reverts to the free tier; mail is kept but new mail beyond the free quota is refused until you renew or delete mail.
8. Your content
You own your mail. You grant us only the rights needed to operate the Service: to store ciphertext, transmit messages you send, and process incoming messages for delivery and spam scoring before encryption. We do not claim any other rights in your content and we do not use it for advertising or model training.
9. Termination
- You may delete your account at any time from the Account page. Deletion is immediate and permanent: mail, addresses and domains are removed and the encrypted blobs are wiped.
- We may suspend or terminate accounts that breach these terms, that we are legally required to terminate, or that are used in ways that threaten the Service. Where lawful and practical we will tell you why.
- We may delete free accounts that have not been used for 12 months. Because we do not record login times, we determine inactivity by the absence of any stored session activity or mail movement over that period, using only counters that do not record when.
- If we discontinue the Service we will give at least 60 days' notice on the Service and refund the unused portion of any paid plan.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure against every threat.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the Service, including loss of mail through a forgotten password. Our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability for intent, gross negligence, or where it cannot be limited by law.
12. Indemnity
You will indemnify us against claims, damages and costs (including reasonable legal fees) arising from your content or your breach of these terms or the law.
13. Changes to these terms
We may update these terms. Material changes will be announced on the Service at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated terms. If you do not, delete your account before they take effect.
14. Governing law and venue
These terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Bern, Switzerland have exclusive jurisdiction, subject to mandatory consumer-protection rules that give you the right to sue or be sued where you live.
